Asirui Networks Inc Acceptable Use Policy

1. Definitions

For the purposes of this Acceptable Use Policy (“AUP”), the following definitions apply, and are fully aligned with the Asirui Networks Inc Terms of Service and Privacy Policy:

  • Agreement: The Asirui Networks Inc Terms of Service, of which this AUP is an integral, binding, and enforceable component.
  • Services: All cloud infrastructure, virtual private server (VPS), dedicated server, network hosting, and related services provided by Asirui Networks Inc.
  • Site: The official website of Asirui Networks Inc, including all subdomains, account portals, and associated web properties.
  • Client: Any individual or legal entity that creates an account, purchases, accesses, or uses the Services provided by Asirui Networks Inc (“you”, “your”).
  • Asirui: Asirui Networks Inc, the sole service provider and controller of the Services.
  • System: All network infrastructure, servers, hardware, software, and platforms owned, operated, or managed by Asirui.

2. Scope of This Policy

This AUP sets out the permitted and prohibited uses of the Services, and applies to all Clients, end users, and third parties accessing or using the Services, directly or indirectly.

By accessing or using the Services, you unconditionally agree to comply with this AUP, in addition to all terms of the Agreement and Privacy Policy. Asirui retains the sole and final right of interpretation for all provisions of this AUP, to the fullest extent permitted by applicable law.

This AUP does not apply to:

  • Services provided by third-party vendors, platforms, or websites linked to or referenced on the Site
  • Activities conducted by Asirui as a data processor on behalf of a Client, under a separate, executed data processing agreement

3. Prohibited Activities

You may not use the Services for any activity that violates applicable laws, infringes on the rights of others, disrupts the integrity of our Systems, or harms other users. All activities listed below are strictly prohibited, and constitute a material breach of the Agreement.

3.1 Illegal & Unlawful Activities

  • Using the Services to engage in, facilitate, or support any criminal or illegal activity, including but not limited to fraud, money laundering, drug trafficking, arms trafficking, or financial scams such as pyramid schemes, chain letters, deceptive investment offers, or check fraud
  • Providing support, resources, or services to any organization designated as a terrorist organization by the U.S. government, the United Nations, or any applicable governing authority
  • Using the Services to promote, host, or facilitate gambling activities that violate applicable federal, state, or local laws
  • Hosting, storing, transmitting, or distributing any material related to child pornography, child sexual exploitation material, or any content that harms, endangers, or exploits minors in any way
  • Violating any applicable export control, sanctions, or trade restriction laws of the United States or any relevant jurisdiction
  • Engaging in any activity that violates the privacy, publicity, or personal rights of any third party under applicable law

3.2 Network Abuse & Service Interference

  • Engaging in any activity that disrupts, interferes with, or degrades the performance of Asirui’s Systems, network, Services, or the systems and services of other third parties
  • Launching or facilitating network attacks, including but not limited to DDoS attacks, DoS attacks, port scanning, vulnerability scanning, brute-force attacks, SYN floods, UDP floods, or any other activity designed to overwhelm or disable a system or network
  • Using the Services to maintain artificial or continuous connections that place excessive and unreasonable strain on our network, including but not limited to constant automated pinging, connection keep-alives that exceed reasonable usage thresholds, or bandwidth-intensive operations that materially disrupt service for other users
  • Using IP addresses not explicitly assigned to you by Asirui, including IP spoofing, forging network header information, or modifying identifying network data to deceive, mislead, or conceal your identity
  • Configuring your services to operate as an open relay, open proxy, or other unsecured service that can be exploited by third parties for unauthorized activity

3.3 Email & Messaging Abuse

  • Sending, transmitting, or facilitating the delivery of unsolicited bulk email (SPAM), unsolicited commercial messages, or mass communications that violate the CAN-SPAM Act, GDPR, or any other applicable anti-spam law
  • Hosting websites, services, or content that support spammers, or that cause Asirui’s IP addresses to be listed on spam blocklists or reputation databases
  • Engaging in email bombing, message flooding, or any other activity designed to disrupt, disable, or overwhelm a user’s email or messaging service
  • Forging, altering, or obscuring email headers, sender information, or message metadata to conceal the origin of a communication, or to impersonate another individual, entity, or organization

3.4 Intellectual Property & Copyright Infringement

  • Hosting, storing, transmitting, or distributing any content, material, or software that infringes on the copyright, trademark, patent, trade secret, or other intellectual property rights of any third party
  • Circumventing, disabling, or interfering with any digital rights management, copyright protection, or access control measures for protected content or systems
  • As set forth in Section 7 of this AUP, we comply with the Digital Millennium Copyright Act (DMCA), and will respond to valid copyright infringement notices in accordance with applicable law

3.5 Malicious Content & Software

  • Distributing, hosting, or transmitting malware, ransomware, spyware, adware, trojans, viruses, worms, botnets, or any other malicious code or software designed to harm, disrupt, or gain unauthorized access to any system, device, or network
  • Using the Services to host phishing websites, scam portals, or any content designed to trick users into disclosing sensitive information, credentials, or financial data
  • Distributing tools, software, or instructions designed to facilitate any of the prohibited activities listed in this AUP

3.6 Security Violations

  • Attempting to gain unauthorized access to Asirui’s Systems, accounts, or infrastructure, or the systems, accounts, or infrastructure of any third party
  • Conducting penetration testing, vulnerability scanning, stress testing, or security testing of any Asirui System, or any third-party system, without the explicit, written authorization of the legal owner of the system
  • Interfering with, or compromising, the security integrity of Asirui’s Systems, or any third-party system
  • Using the Services to bypass or circumvent security measures, firewalls, or access controls of any system or network

4. Fair Usage & Service-Specific Rules

All use of the Services is subject to the following fair usage and operational rules, designed to ensure consistent service quality, security, and reliability for all Asirui Clients.

4.1 Bandwidth & Resource Fair Usage

  • Shared bandwidth, unmetered bandwidth, and shared resource plans are subject to fair usage principles. Sustained, excessive usage that materially impacts network performance for other Clients may result in traffic shaping, rate limiting, or temporary resource restrictions at Asirui’s reasonable discretion
  • You may not use the Services to operate a content delivery network, file hosting service, or bulk data storage platform that consumes disproportionate network or storage resources, unless explicitly approved in a custom, written service agreement with Asirui

4.2 DDoS Mitigation Services

  • DDoS mitigation services are provided solely to protect your services from legitimate, unsolicited DDoS attacks, in line with normal business usage patterns
  • You may not intentionally trigger, simulate, or facilitate DDoS attacks against your own services, or engage in any activity that causes unnecessary strain on our mitigation infrastructure
  • Asirui reserves the right to null route IP addresses, restrict traffic, or suspend services if your usage of mitigation services disrupts our network for other Clients

4.3 Content Hosting Rules

  • You are solely and exclusively responsible for all content hosted, stored, or transmitted via the Services. Asirui does not pre-screen, monitor, or moderate user content, except as required by law or to enforce this AUP
  • Hosting of adult content is permitted only if it complies with all applicable laws, does not involve non-consensual content, does not exploit minors, does not violate the intellectual property rights of any third party, and includes all required legal disclosures and age verification measures
  • You must ensure that all content hosted on the Services complies with all applicable local, state, federal, and international laws and regulations

5. User Accountability & Responsibilities

  • You are fully and solely responsible for all activities conducted via your account, services, and systems, regardless of whether the activity was authorized by you
  • You are responsible for ensuring that your account, services, and systems are not used by third parties (including end users, customers, or unauthorized actors) to violate this AUP, the Agreement, or applicable law
  • You must implement reasonable and appropriate security measures to protect your account, services, and systems from unauthorized access or misuse
  • You agree to cooperate fully with Asirui in any investigation of suspected violations of this AUP, including providing access to relevant information, and taking immediate corrective action as required
  • You agree to indemnify and hold harmless Asirui from any claims, damages, losses, or liabilities arising from your violation of this AUP, or the use of your account by third parties to violate this AUP

6. Consequences of Violation

Any violation of this AUP constitutes a material breach of the Agreement, and may result in any of the following actions, at Asirui’s reasonable discretion:

  1. Issuance of a formal written warning, requiring immediate corrective action within a specified timeframe
  2. Temporary restriction of network access, bandwidth, or non-critical service features
  3. Suspension of the affected Services, pending a full investigation and required corrective action
  4. Immediate termination of all Services and your account, with no refund of any pre-paid fees, for severe, repeated, or illegal violations
  5. Permanent ban from future use of Asirui’s Services and platforms
  6. Disclosure of relevant information to law enforcement authorities, regulatory bodies, or affected third parties, as required by applicable law
  7. Pursuit of legal action to recover damages, or enforce our rights under the Agreement and applicable law

Asirui reserves the right to take any of the above actions immediately, without prior notice, if the violation poses an immediate security risk to our Systems, other Clients, or the public, if the violation involves illegal activity (including child sexual exploitation material), or if required by law.


7. DMCA Copyright Compliance & Violation Reporting

7.1 DMCA Copyright Infringement Notices

Asirui complies with the Digital Millennium Copyright Act (DMCA). If you believe that your copyrighted work has been infringed via our Services, please submit a valid DMCA notice to our designated Copyright Agent at:

A valid DMCA notice must include all elements required by federal law, including:

  • A physical or electronic signature of the copyright owner or authorized agent
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing, with sufficient detail to allow us to locate it
  • Your contact information, including address, telephone number, and email address
  • A statement of good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  • A statement, under penalty of perjury, that the information in the notice is accurate, and that you are authorized to act on behalf of the copyright owner

All reports will be investigated promptly, and we will take appropriate action in accordance with this AUP and applicable law.


8. Policy Updates

Asirui reserves the right to update, amend, or modify this AUP at any time, in our sole discretion, to ensure compliance with applicable laws, maintain network security, and preserve service quality for all Clients.

Any revised version of this AUP will be posted on the Site, with an updated “Last Revised” date. Continued use of the Services after the effective date of the revised policy constitutes your unconditional acceptance of the changes. We will notify you of material changes to this AUP via email or a prominent notice on the Site, where required by law.
